“Next Up!” Youth Baseball + Softball Clinic Participant Release, Waiver of Liability, Covenant Not to Sue,  Indemnification Agreement and Image Release In consideration for allowing the undersigned to participate in activities related to the Next Up Youth Baseball + Softball Clinic (“Event”) the participant named below (“Participant”), for himself/herself, his/her personal representatives, heirs, and next of kin: • Acknowledges and agrees that he/she accepts full responsibility for his/her own safety and for determining that no dangerous conditions exist that could affect his/her own safety at any of the Event sites; and • Acknowledges, agrees and represents that his/her participation in the Event constitutes and acknowledges that he/she finds and accepts the Event sites as being safe and reasonably suited for the purpose of his/her use, and further agrees and warrants that if, at any time he/she feels anything to be unsafe, he/she will immediately advise the Greater Cleveland Sports Commission (GCSC), City of Cleveland, League Park, Community Cup Classic Foundation staff of such and will immediately withdraw from the dangerous area; and • That there may be risk of injury from the activities involved in the Event, including the potential for paralysis and death, and while rules, equipment, and personal discipline may reduce the risk, the risk of serious injury cannot be eliminated; and • Hereby releases, waives, covenants not to sue, and forever discharges the Greater Cleveland Sports Commission (GCSC), City of Cleveland, League Park, Community Cup Classic Foundation or any subdivision thereof, and each of them, their officers, employees, and agents (all for purposes herein referred to as “Releasees”) from any claims for liability, including liability for Releasees’ negligence, to the undersigned, his/her personal representatives, assigns, heirs, and next of kin, for any and all injury, death, loss, or damage arising from the Participant’s participation in or attendance at the Event; and • Hereby agrees to hold harmless and to indemnify the Releasees from and against all claims, actions, damages and expenses, including but not limited to reasonable attorney’s fees for any alleged injury and/or death to any person or damage to any property arising, or alleged to have arisen out of any negligent, reckless or intentional act of the Participant or failure to act on the part of the Participant, his/her heirs, successors or assigns. If signing this document as a parent or guardian of a Participant under the age of eighteen (18), the undersigned certifies that he/she is in fact the true, lawful parent or legal guardian for each minor Participant listed below, and for himself/herself, and on behalf of each Participant, acknowledges and agrees to the provisions of this document, including, without limitation, the releases above, and further agrees to defend and indemnify the Released Parties if any information contained herein is incorrect or untruthful. Participant further agrees to allow, and hereby grants to the Greater Cleveland Sports Commission (GCSC), City of Cleveland, League Park, Community Cup Classic Foundation, and their representatives and licensees, without further consideration, a worldwide, perpetual, and unlimited right and license to use Participant’s likeness in any and all media existing now or in the future, to advertise, promote, or publicize such parties, their products or services, events or activities, including the Event. Participant understands and agrees that the releases, waivers, covenant not to sue, and indemnification provisions of this document are intended to be as broad and inclusive as is permitted by applicable law and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. ********************** I have read this document, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.
